** Note:  When reading case law, you want to pay attention to the "prongs".  When deciding cases Judges look to see if they meet the criteria prescribed in case law.  There will be a two to four "prong test" that must be met to win a case.  This is similar to bringing criminal charges against someone, where you have to make sure you have all the "elements" of the charge.  I try to find the Supreme Court Cases that  dictate the "prong test" so you can apply it to any situation that you find yourselves in, no matter what State you are an officer in.

Summary Judgment is normally the first motion that is filed after discovery is complete.  This means, that after discovery is exchanged, both sides tell the Judge why they believe that they should win the case and they try to convince the Judge that no matter what, they will win.   The idea behind this is to save time and money by not going to trial.  If the Judge is convinced that there is no way one side can win the case he will award "Summary Judgment" to the other side, ending the case.  More often than not Summary Judgment Motions are denied.
